My research shows the Special Counsel Office was split from the Executive Branch with the Civil Service Reform Act of 1978.  The law explicitly states Special Counsel reports to the President and Congress.  While that is ambiguous, since it was created by a law of Congress without "execution", that office reports to Congress.

Precedent is the Treasury.  Not all departments are 'executive departments':
